This article is an introduction to special education in Irish secondary
schools. The past then years have witnessed a sea change in special
education provision in Ireland. The Department of Education and Science
has issued numerous directives and guidelines in relation to policy,
provision, structure and supports. Since 1998 there have been ten pieces
of legislation passed through the Daily that relate, one way or another
to children and special education needs The National Council for
Special Education (NCSA) has been established along with the Special
Education Support Service (SES). Both these organizations oversee and
coordinate all special education initiatives nationwide. Ireland's
primary schools have pioneered these new directives. Special education
provision at primary level is developing at a rapid pace and great
strides are being made. The next horizon for improvement is secondary
school.
Ireland's secondary schools are driven by an
exam-oriented curriculum. Subject area specialists teach all of the
curricular content. The supports available to children with special
needs are not extensive or as tested as those at primary level. In what
follows we will look at the needs and entitlements of children entering
secondary school who have identified special education needs and those
who are entering and later discovered to have a special education need.
My child has been receiving extra help in primary school. What should I look for in a secondary school?
You
should look for a school with a special education teacher in place on a
full-time basis to support all children with special needs in the
school. It is important to also be sure the school has a commitment to
supporting and educating children with special needs. The school should
have on its staff teachers who have had some training in how to
differentiate their methodology and curriculum for children with special
needs. There should be an accepting attitude on the part of all staff.
Remember, your child is entitled to enter fully into the life of the
school and avail of all it has to offer. How do you find out these
things? Talk to the school principal and ask questions about the topics
listed above. Remember, your child may be eligible for special
consideration at the time of Junior Cert and Leaving Cert but this will
have to be determined about a year before these exams will be taken.
What is s/he entitled to?
A
child who has been receiving special education resources or support in
primary school is eligible for continued support at secondary level so
long as they continue to have a special education need. It is possible
that a primary school child, after receiving several years of support,
could no longer be deemed to have a special education need but this is
the exception not the rule.
Your child will be entitled to the
same general provision he or she received in primary school. Typically
this takes the form of specialist teaching from a Learning Support or
Special Education Resource teacher (both are now often being referred to
simply as Special Education teachers. This support is to be determined
based on need with the number of hours of support being determined by
the Individual Education Plan (IEP) drawn up in the last year of primary
school. In addition to the IEP there should have been a Transition Plan
completed during the last year of primary school The Transition Plan
will devise the structure of transition to secondary school and may
alter the IEP for a short period of time. If this happens there should
be a team meeting in about six months or less to write the secondary
school IEP. In general students in secondary school are eligible for the
same supports as in primary school. This may include a Special Needs
Assistant (SÃO).
How do I go about making sure they get that?
Generally
speaking your child's Individual Education Plan is the map which
documents exactly what services your child will receive, when he or she
will receive them and from whom. The IEP is your best protection against
a child not receiving the services they need. IEP's will eventually
become legally binding documents on all parties and a school must
provide the services outlined in the IEP. An IEP cannot be changed or
implemented without your consent. Remember that upon entering secondary
school a Transition Plan may be in place that slightly alters the
previous IEP. This will have to be reviewed within a short span of time
to be sure the child receives appropriate support services. Don't be
afraid to talk to the school principal because he or she is ultimately
responsible to see to it that children receive the services they are
entitled to receive.
What are my options if we run into difficulties?
Should
problems arise you should first speak to the Year Head and address your
concerns. The Special Needs Organizer (SEO) assigned to the school
should be alerted as well as the appropriate special education
teacher(s). A team meeting, of which you are entitled to be a member,
can be convened within a reasonable time frame and your concerns will be
discussed. If this meeting does not satisfy you or not result in the
child receiving the services you may contact the National Council for
Special Education for further information and support.
It is

special education teacher first and be clear about your concerns. Be
assertive and not aggressive. Remember, generally speaking everyone is
doing the best they can. Do have your child's IEP in front of you when
you are speaking to the teacher or other staff member. Be aware of your
rights to appeal as outlined in the NCSA and SES websites. Don't rush to
judgment, try and work things out amicably before you make threats to
appeal. The next most important port of call will be the Special Needs
Organizer assigned to the school.
Hidden Disabilities
Not
all children who have special education needs come to the attention of
parents or educators in primary school. The human brain is an organ that
tries to meet the demands placed upon it at any given time. As anyone
who has gone to school knows, the demands of the curriculum get greater
and greater each year of schooling. In secondary school the curriculum
subjects become incredibly complex each year. The fact that a student is
being educated by many different teachers each year further complicates
matters. There are students who have had no difficulty suggestive of a
special education need at primary school who suddenly seem to have a lot
of difficulties in secondary school. Unfortunately they are often
perceived as "lazy" or "unmotivated" and sometimes as "difficult"
students.
If these labels stick and no thought or concern
raised about a possible learning difficulty being present the student
can become trapped in a cycle of failure and rejection by teachers. The
result could be early school leaving, behavior difficulties to hide the
learning problem, lowered self-esteem, loss of self-confidence and
trouble at home. It is important to recognize that some students, no
matter how well they performed in primary school, may have a special
education need that doesn't appear until secondary school.
What are the warning signs?
It
is not possible to list the many warning signs of a hidden disability
but generally speaking one should be considered any time a student with a
previously successfully record in primary school begins to exhibit
difficulties in secondary school. There are a variety of causes to
school failure at second level but a hidden disability can often be
reasonably suspected when one or more of the following difficulties
become noticeable:
memory problems
organizational difficulties
refusal to go to school
problems with written language expression
difficulty organizing thoughts into speech
inability to recall facts from yesterday's lesson even if they seemed retained the night before
unusual spelling problems
unusual difficulty with more advanced mathematical problems
pronounced difficulty in foreign language class
behavioral difficulties not present in primary school
nonfood swings or sudden mood changes that last several hours
reluctance to engage with parents about school difficulties
Although
a partial list it is a good guide for parents and teachers to
thoughtfully consider the presence of a hidden learning disability.
I think my child may have a problem. Where do I go from here?
First
speak with your child's teachers. Ask for the facts: what does teacher
think the problem might be? How often is this occurring? When? Is it
serious? Present your own perception to the teacher(s) clearly and
succinctly. If you have done some Internet homework on your own be clear
about it and raise it as a query needing to be resolved. Try and get
some samples from homework you have seen and ask for some samples of the
child's work in class if it is appropriate to do so. Speak to the Year
Head and ask him or her to get some information about your concerns from
all teachers. See if you can spot a pattern that validates your
concern.
If you become more concerned then you have a right to
ask for an assessment. Sometimes the special education teacher, with
your permission, can perform some individually administered tests to
discover if the child is seriously behind in reading or math achievement
age. It is possible to discover if there are significant written
language deficits in some cases. If this assessment leads to more
significant concerns then you should request a psychological assessment.
These can be provided free by the National Educational Psychological

referred to as a multidisciplinary team, will be responsible for writing
the IEP. You are a member of that team. Your child is also entitled to
be a member of the team and it is particularly important for secondary
school students to participate in this stage of planning. This gives
them a sense of ownership and control over their educational life.
Be
sure that the plan covers all the areas of concern that have been
discovered in the assessment process. Plans for children with social and
behavioral difficulties that address only academic issues are useless
and doomed to fail. Special education planning is a thoughtful and
time-consuming process when it is done correctly. Don't feel rushed into
accepting a plan you don't think will work. Take it away and ask if you
can return in a week to revise it with the team. This may not make you
the most popular parent in the school but it is responsible parenting.

Education
in India is regulated at both central and state government levels. As a
result, regulations often differ from state to state. K-12 education is
governed by the respective State School Education Act and the Central
Board of Secondary Education (BSE) Rules and Regulations concerning
affiliation and/or the rules of any other affiliating body. Under
current regulations, only not-for-profit trusts and societies registered
under Societies Registration Act, 1860, and companies registered under
section 25 of the Companies Act, 1956, qualify to be affiliated with the
BSE and to operate private schools.
While the K-12 segment
accounts for the lion's share of India's educational market, weaving
through the complex regulatory roadmap to qualify for affiliation poses
serious difficulties for investors. The BSE requires privately-funded
schools to be non-proprietary entities without any vested control held
by an individual or members of a family. In addition, a school seeking
affiliation is expected to have a managing committee controlled by a
trust, which should approve budgets, tuition fees and annual charges.
Any income accrued cannot be transferred to the trust or school
management committee and voluntary donations for gaining school
admission are not permitted.
Schools and higher education
institutions set up by the trust are entitled to exemptions from income
tax, subject to compliance with section 11 of the Income Tax Act, 1961.
In order to qualify for tax exemptions, the trust needs to ensure that
its predominant activity is to serve the charitable purpose of promoting
education as opposed to the pursuit of profit.
Alternative paths
Alternative
routes do exist for investors seeking to avoid the web of regulatory
barriers that constrain their involvement. Sectors such as pre-schools,
private coaching and tutoring, teacher training, the development and
provision of multimedia content, educational software development, skill
enhancement, IT training and e-learning are prime sectors in which
investors can allocate their funds. These areas are attractive because
while they relate closely to the profitable K-12 segment, they are
largely unregulated. As such, they make attractive propositions for
private investors interested in taking advantage of the burgeoning
demand for quality education. Companies such as Educe Solutions, Career
Launcher, NIT, Optec, and Magic Software, are market leaders in these
fields. Educe recently acquired a large number of educational institutes
and service providers across India. It has also formed joint ventures
with leading higher education groups, including Raffles Education
Singapore, for the establishment of higher education institutions and
universities in India and China. Furthermore, it has entered into a
multi-million dollar collaboration with Anal Properties and
Infrastructure to set up educational institutions and schools across the
country and closed an US$8.5 million deal to acquire Euro kids
International, a private provider of pre-school educational services in
India. Ganja Capital India, an education-centric fund, has completed the
funding of three education services companies in India. NIT and Optec,
meanwhile, are engaged in the IT training business.
Core
Projects and Technology is also focusing heavily on India and is likely
to bid to takeover, upgrade and run public schools for specified periods
on a public-private partnership basis.
Higher hurdles
While
state governments are largely responsible for providing K-12 education
in India, the central government is accountable for major policy
decisions relating to higher education. It provides grants to the
University Grants Commission (GC) and establishes central universities
in the country. The GC coordinates, determines and maintains standards
and the release of grants. Upon the GCS' recommendation, the central
government declares the status of an educational institution, which once
authorized, is entitled to award degrees.
State governments
are responsible for the establishment of state universities and colleges
and has the power to approve the establishment of private universities
through State Acts. All private universities are expected to conform to
the GC guidelines to ensure that certain minimum standards are
maintained.
Amity University in Utter Pradesh is one of the
private universities to open its doors. It was approved by the Utter
Pradesh state legislature on 12 January 2005 under section 2(f) of the
University Grants Commission Act.
Not-for-profit and
anti-commercialization concepts dominate higher education fee
structures. To prevent commercialization and profit-making, institutions
are prohibited from claiming returns on investments. This, however,
does not pose a hurdle for universities interested in mobilizing
resources to replace and upgrade their assets and services. A fixation
of fees is required in accordance with the guidelines prescribed by the
GC and other concerned statutory bodies. For this purpose, the GC may
request the relevant information from the private university concerned,
as prescribed in the GC (Returns of Information by Universities) Rules,
1979.
In line with the policy on Fee Fixation in Private
Unaided Educational Institutions Imparting Higher and Technical
Education, two types of fees are required: tuition fees and development
fees. Tuition fees are intended to recover the actual cost of imparting
education without becoming a source of profit for the owner of the
institution. While earning returns on investment would not be
permissible, development fees may provide an element of partial capital
cost recovery to the management, serving as a resource for upkeep and
replacement.
Legal precedents
In order to be awarded
university status by the GC, institutions must comply with the
objectives set forth in the Model Constitution of the Memorandum of
Association/Rules, and ensure that no portion of the income accrued is
transferred as profit to previous or existing members of the
institution. Payments to individuals or service providers in return for
any service rendered to the institute are, however, not regulated.
In
this context recent court judgments on private universities are
relevant. The Supreme Court, in Gunneries JP v State of Andrea Pradesh,
introduced a scheme regulating the admission and levy of fees in private
unaided educational institutions, particularly those offering
professional education. The ruling was later notified in the fee
policy.
Subsequently, in the case of Prof Asphalt and AMR v
State of Chatting and Ors in 2005, the Supreme Court assailed the
Chatting government's legislation and amendments which had been abused
by many private universities. It was contended that the state
government, simply by issuing notifications in the Gazette, had been
establishing universities in an indiscriminate and mechanical manner
without taking into account the availability of any infrastructure,
teaching facilities or financial resources. Further, it was found that
the legislation (Chatting Meiji Sherpa Inhabitable (Sharpen Aura
Indiaman) Sardinian, 2002) had been enacted in a manner which had
completely abolished any kind of GC control over private universities.
The
Supreme Court concluded that parliament was responsible for ensuring
the maintenance and uniformity of higher education institutions in order
to uphold the GCS' authority. Following the judgment, only those
private universities that satisfied the GCS' norms were able to continue
operating in Chatting.
Professional institutions
Professional
and technical education in India is regulated by professional councils
such as the All India Council for Technical Education (ALICE).
Established under the ALICE Act, 1987, ALICE gives recognition to
courses, promotes professional institutions, provides grants to
undergraduate programmers, and ensures the coordinated and integrated
development of technical education and the maintenance of standards. The
ALICE has recently exerted pressure on unrecognized private technical
and management institutes to seek its approval or face closure.
A
single bench decision of the Delhi High Court in Chartered Financial
Analysis Institute and AMR v ALICE illustrates the far-reaching
implications this kind of pressure can have on all institutions
operating independently of the ALICE. The court found that the Chartered
Financial Analyst Institute, a US-based organization, was engaged in
imparting technical education and that its charter, though not described
as a degree or diploma, was nevertheless descriptive of the candidate
attaining an academic standard, entitling him to pursue further courses,
and achieve better prospects of employment in the investment banking
profession. The ALICE argued that the Chartered Financial Analyst
Institute fell within the ambit of its regulation and was therefore
obliged to submit to the jurisdiction of the regulatory body. The Delhi
High Court upheld the Apices' view that the Chartered Financial Analyst
Institute did qualify as an institution imparting technical education..
This
judgment may have emboldened the ALICE to proceed against a number of
other establishments that are on its list of unapproved institutions. It
holds particular significance since despite not granting degrees and
diplomas, the Chartered Financial Analyst Institute was still deemed by
the court to be covered under the description of a "technical
institute".
Enthusiasm grows for foreign participation
While
regulators such as the ALICE continue to exercise influence in the
Indian education system, the sector is expected to witness a surge in
foreign investment and perhaps a reduction in the number of regulatory
roadblocks as a result of the central government's enthusiasm for
overseas investors. Foreign direct investment in higher education could
help reduce government expenditure and there is a general consensus that
education as a whole should be opened for domestic and foreign private
participation.
The entry of foreign educational institutions
into India will be covered by the new Foreign Education Providers
(Regulation for Entry and Operation) Bill. The bill seeks to regulate
the entry and operation of foreign education providers, as well as limit
the commercialization of higher education. Foreign education providers
would be given the status of "deemed universities" allowing them to
grant admissions and award degrees, diplomas or certificates.
Operationally,
the bill proposes to bring foreign education providers under the
administrative umbrella of the GC, which would eventually regulate the
admissions process and fee structures. Since these foreign institutions
will have to be incorporated under central or state laws, they will also
be subject to the government's policies of reservations. The bill is
pending approval from the Indian Parliament but it is unclear if it will
be taken by the present government for a vote prior to the general
elections in 2009.
Innovative structures unlock profitability
The
regulatory restraints on running profitable businesses in the K-12 and
higher education sectors have driven Indian lawyers to devise innovative
structures that enable private investors to earn returns on their
investments. These typically involve the establishment of separate
companies to provide a range of services (operations, technology,
catering, security, transport, etc.) to the educational institution. The
service companies enter into long term contracts with the trust
operating the institution. Payments made by the trust to the service
companies must be comparative and proportionate to the services rendered
by such companies. Furthermore, in order to qualify for tax exemptions,
the expenses paid by the trust to the service companies must not exceed
what may reasonably be paid for such services under arm's length
relationships.
Despite the regulatory constraints, the Indian
education sector is on a path of exponential growth. A growing number of
private companies are undertaking creatively structured projects in the
education business and the level of investor confidence is demonstrated
by the recent spate of M&A activity that has taken place.
With
more domestic players emerging, the education sector is likely to
witness consolidation, but at the same time, increasing foreign
participation will drive competition and raise standards. Liberalization
will continue to intensify as the government struggles to remedy its
poor public education system and provide quality institutions to educate
India's masses.

15. Move student's desk to where there are fewer distractions. Most of the time that will be beside the teacher, up front or beside a quite child.
16. Many times it's better to use rows for seating if possible. Group seating is just too much stimuli for them.
17. Keep a portion of the room free from visual stimuli, noise and windows.
18. Use headphones to play while noise or soft music to help block out what is going on in the classroom.
19. State directions, write them down, speak them and repeat. Special needs children need information more than once and in multiple formats.
20. Be sure to get eye contact. They sometimes are not "able" to pay attention. Reward or praise them when they do have eye contact. This is very difficult for them.
21. Allow escape if a child can't deal with a problem. Allow them to go to the assigned area in the classroom where they can go and calm down.

The Cost and Benefits of Social Inclusion in Education - Should Failure Still Be an Option?
'Social inclusion' has now resulted in many if not all, special schools closing their doors and their students attending mainstream institutions. The promise of 'social inclusion' sadly, is an illusion. Students, who previously would have attended schools with teachers trained to help them, are not included in the peer groups of so called 'normal' students just because they attend a mainstream school. In many cases, teachers are not trained to deal with their specific needs and simply do not have the capacity to cater for the very broad spectrum of students in their classes. At the same time, the academic progress of the other students in the class is held back, whilst the teacher attempts to ensure that the disadvantaged students do not fall too far behind. At both ends of the spectrum of students, this situation is a recipe for boredom and behavioural issues to surface, which further reduces the learning that should take place.
Social inclusion was first introduced with a government commitment to provide the necessary Aide time for those students in need. However, over time the bar has been set so high to receive Aide funding for a student that it is almost impossible to qualify, unless the student is severely mentally or physically impaired and is unlikely to be ever able to function independently, even into adulthood. This then begs the question, 'what does social inclusion achieve in those instances'? Such individuals are seldom accepted by their peers as equals and if not directly bullied will always 'stand apart from the herd'. Meanwhile, those who have some potential to become independent and self-sufficient adults, but who are still somewhat disadvantaged, compared with the 'norm' are left to struggle on or fall further behind, deprived of any support. Yet, this group with a little 'seed funding' should not become a burden on the tax payer in later years.
Previously, special schools were available for students unable to cope in mainstream education. Special needs students gained confidence and coped well in an institution predominantly tailored to suit their needs, whilst under the direction of trained staff to help them reach their full potential. Such schools were also able to offer a better student to teacher ratio, than is feasible in mainstream schools.
The decline of special schools has been further complicated with the abandonment of what is now considered the politically incorrect practice of 'streaming'. Students used to be allocated to classes based on ability groupings which saw students with similar academic abilities sharing the same class. This is now a practice that cannot be condoned openly as it seen to label a student. However, students label each other very effectively within grade years and mixed ability classes anyway, they do not act as a homogenous group; they clump together based on a number of criteria that also includes academic ability. Streaming of classes simply identifies students of similar academic ability in a particular subject and would greatly improve their progress as a group precisely because the teacher can pitch their learning to the group's ability levels, rather than deliver a programme aimed at some intermediate level in the hope that those in the class at the bottom end of the spectrum can keep up, whilst those at the top, do not become bored. Good in theory but very difficult to put into practice effectively day in, day out, throughout the year. The closure of special schools for the educationally disadvantaged has only exacerbated this by further widening the academic gap between students in the classroom.
Meanwhile, the possibility of failure was always a component of normal education until recent times. Progress in education presumed that the individual had learnt sufficiently in the present academic year to be able to cope with the next. In the last twenty or so years this presumption has largely been abandoned in primary and secondary education. Students progress from one year to the next irrespective of what they have learned. There are arguments for and against this trend. In favour is the fact that the student progresses with his peer group and thereby avoids the social stigma attached to being 'held back'. Their self esteem is thereby not undermined. Unfortunately, this trend also means that the student hardly experiences failure until after they leave school, at which point the real world teaches them a very hard lesson, namely that they cannot be protected from failure and that contrary to what we may wish for, the adult world is competitive and there are winners and losers in all aspects of life.
Experiencing failure in school hardens a student to cope with challenges in adulthood; it builds resilience and is an intrinsic motivator. If there is no chance of failure and its unwished for consequences, then there is little in the way of a driving force to succeed and only those students who can somehow develop motivation from within or who are driven by external forces, such as their parents, will succeed. The present system also drags down those who would otherwise have risen to the challenge of education because those who do not have the motivation will target those who do and seek to reduce their ambitions. It is 'not cool' as a teenager to be labelled as a 'nerd' because you actually want to learn; many otherwise capable students succumb to this sort of peer pressure.
